'Where is the Child, Nobody Knows...' Atul Subhash's Mother Appeals to Supreme Court for Custody of Grandson

Seeking justice in the case of Atul Subhash's tragic demise, his mother has approached the Supreme Court, requesting custody of her grandson, Atul's young son. The Supreme Court has now issued notices to the governments of Uttar Pradesh, Haryana, and Karnataka, demanding a response to this habeas corpus petition.

The petitioner, Atul's mother, has filed a habeas corpus petition to secure custody of her four-and-a-half-year-old grandson, expressing concern about his whereabouts, which remain unknown. Therefore, it has been requested that the child be handed over to his grandparents after questioning Nikita.

Nikita informed the police that her son is studying at a boarding school in Faridabad and that his custody lies with her uncle, Sushil Singhania. However, Sushil denied having any information or custody of the child.

Hearing Scheduled in January

Atul's wife, her brother, and mother are also in custody. Therefore, it has been requested that the child's custody be given to his grandparents after an inquiry. The involvement of multiple states—Uttar Pradesh, Haryana, and Karnataka—has led to a plea for the Supreme Court's intervention. An appeal has been made to bring the child before the court.

The Supreme Court bench, comprising Justice B.V. Nagarathna and Justice N. Kotishwar Singh, has notified the three states, with the next hearing scheduled for January.

No Information on the Child

Currently, Nikita, her mother, and brother are all in custody. This raises the critical question: who is caring for Atul and Nikita’s four-year-old son? Where is he at present, and who is looking after him? Astonishingly, nobody is aware of where Nikita left or hid her son before her arrest.

Before his death, Atul explicitly stated in his 23-page suicide note and a final video lasting one hour, twenty-one minutes, and forty-six seconds, that he wished for his parents to take responsibility for his son after his death. Atul's father also expressed ignorance about the current location of his grandson, insisting that they be granted custody to fulfill his son's last wish.
