On a case involving Yasin Malik, the Supreme Court referenced Ajmal Kasab on November 21. This was during the hearing of an appeal by the Central Bureau of Investigation (CBI). The CBI challenged a Jammu court’s decision that required separatist leader Yasin Malik to attend court proceedings. The Supreme Court noted that Ajmal Kasab, the terrorist involved in the 26/11 Mumbai attacks, was given a fair trial.
It is significant to note that Yasin Malik is accused of the 1990 murder of four Indian Air Force officers near Srinagar and the 1989 kidnapping of Rubaiya Sayeed, the daughter of then Union Home Minister Mufti Mohammad Sayeed.
During the proceedings, the Supreme Court asked Solicitor General Tushar Mehta to explore the possibility of conducting the hearing within Tihar Jail, as Yasin Malik is currently imprisoned there.
Responding to the Court's remark, SG Mehta stated he would seek directions on the matter. He emphasized that Malik should not be transported to Jammu due to concerns for the safety of witnesses.
The Solicitor General informed the bench that Malik insisted on being present in person and refused to appoint a lawyer. Mehta presented a photo of Malik with Hafiz Saeed, founder of Lashkar-e-Taiba, arguing that Malik is no ordinary accused.
Malik has been a controversial figure, having shared the stage with various prominent individuals. This raises concerns about his influence and the implications for regional stability.
