UP: High Court Halts Demotion of 890 Head Constables

The Allahabad High Court has halted the Uttar Pradesh government's decision to demote and transfer 890 head constables to the PAC. This move came as a result of UP Police's decision to demote these head constables. In opposition, Paras Nath Pandey and hundreds of head constables filed a petition against this order.

The petition challenges the orders passed on September 9 and September 10, 2020, by the DIG Establishment and the Additional Director General of Police at the Uttar Pradesh police headquarters. These orders resulted in the demotion of 890 head constables deployed across various districts.

Affected constables have strongly criticized this decision, arguing that it undermines the morale of the police department and have turned to the courts for redress.

Upon being informed of the situation, Chief Minister Yogi Adityanath expressed his displeasure and ordered that the officers be promoted immediately. On September 26, the Chief Minister remarked that actions taken without the state's knowledge could negatively impact police morale. He instructed the Director General of Police to ensure that all head constables receive their due promotions as per protocol. He also called for action against officials who had issued such orders without informing the state government.

Following the Chief Minister's directive, the order was amended. However, the petitioners did not accept this revised order, which suggested promotions within the PAC. The affected head constables rejected this resolution.

Now, the State's Additional Advocate General Manish Goel has requested a month from the court to revise the order once again. The next hearing is scheduled in a month's time.
