The Delhi Police took Kumar into custody on Saturday afternoon. Following interrogation at the Civil Lines Police Station, he was arrested at 4:15 PM. Earlier, Kumar had filed a bail application in Tis Hazari Court which was subsequently dismissed.
During the court hearing, the Delhi Police argued that Kumar's phone was formatted in Mumbai before any data cloning could take place. They added that his presence is required in Mumbai for evidential purposes since he has yet to disclose the phone's passcode; a task not possible without an expert, let alone without Kumar himself.
Vivek Kumar's lawyer, Rajiv Mohan, refuted the pertinence of the phone formatting claiming it has no connection to the case. He stated there were no accusations of threats being issued via WhatsApp or calls. Regarding the password, he argued that Apple does not share its users' passcodes, thus making the arrest unjustified and the request for police custody baseless.
Mohan claimed that Maliwal arrived at the Chief Minister's residence without a prior appointment, questioning the purpose of her visit and bringing up the fact that media footage shows her leaving the residence not in a shirt but in a kurta, contradicting the assault claims.
Mohan further contested the allegations of Maliwal having her head struck against a table, pointing out the absence of any visible injuries and accusing the police of twisting facts. He questioned why the FIR was delayed by three days and why immediate medical attention was not sought.

Prior to today's events, the court had heard Kumar's plea for interim bail. The judge deemed the hearing moot in light of his prior arrest. Kumar's lawyer insisted on innocence, suggesting that the assault accusations were unfounded as numerous people were present at the scene of the alleged crime.
