Supreme Court on ₹12 crore alimony case:
The Supreme Court is hearing a high-profile divorce case about alimony. During the hearing, Chief Justice of India Bhushan Ramkrishna Gavai expressed surprise over a woman's demand for ₹12 crores and a flat in Mumbai as alimony for her 18-month marriage.
18-Month Marriage, ₹12 Crore Alimony Demand
The woman, an IT professional with an MBA, stated that she only wants a flat in Mumbai and ₹12 crores, which she considers 'maintenance'.
To this, CJI Gavai remarked, 'Your marriage lasted only 18 months and you are demanding a crore for each month, along with a BMW!'
CJI Emphasizes Self-reliance
The Chief Justice noted, 'You can easily work in cities like Bengaluru and Hyderabad. You are highly educated… You should not depend on such demands but instead focus on earning your living.'
Woman's Retort and FIR Reference
In response, the woman claimed her husband tried to annul the marriage by declaring her mentally unfit and filed a false FIR, affecting her job. The court assured that it would quash the FIR to ensure her career prospects are not hindered.
Husband's Argument: Abuse of Law
The husband's lawyer argued that the woman's demands are excessive and that she had previously signed a mutual divorce agreement entailing her living in 'Kalpataru Pariyawad society' with more than 20 pending cases between both parties being dropped. However, the woman now refused to proceed with the second motion demanding more money, clearly misusing legal procedures.
Court's Remark: Every Inch Costs in Mumbai
CJI Gavai also noted that the flat the woman is residing in has two parking spaces, which can be monetized in a city like Mumbai.
Final Decision Reserved
After listening to arguments from both sides, the Supreme Court has reserved its final decision. It remains to be seen how the court will resolve this high-profile divorce case.
