‘Don’t Trust Anyone Before Marriage’: Supreme Court on Rape in Live-In Relationships

During a hearing about charges of rape under false promises of marriage, the Supreme Court noted that before marriage, a boy and girl are 'complete strangers' and should exercise caution concerning premarital physical relationships. The court advised both parties to act wisely and prudently. Justices B.V. Nagarathna and Ujjal Bhuyan were considering the accused's bail plea, who is alleged to have engaged in multiple intimate encounters by falsely promising marriage.

During the proceedings, the bench observed that the relationship appears consensual at the surface. Justice Nagarathna remarked, 'We may be considered old-fashioned, but a boy and a girl are strangers before marriage. Great care should be taken in such matters. Trust should not be given blindly.'

Taken to Dubai, Objectionable Videos Made

The woman's attorney informed the court that the pair met in 2022 on a matrimonial website. Allegations indicate that the accused deceived the woman in Delhi and subsequently in Dubai with false marriage vows. The woman asserts that upon his behest, she went to Dubai, where intimate encounters occurred, and her objectionable videos were recorded without consent. She also accuses him of threatening to make the videos public.

Accused of Previous Marriage

In her complaint, she additionally revealed that she later discovered the accused was already married and entered into a second marriage in Punjab in January 2024.

Bail Applications Rejected by Delhi High Court and Lower Court

The bail plea of the accused has already been rejected by the Delhi High Court and a lower court. The High Court observed that the initial promise of marriage seemed false, especially since the accused was already married.

The Supreme Court, suggesting a reconciliation possibility, is considering sending both parties for mediation. The bench requested the accused's lawyer to consider the possibility of compensating the woman. The next hearing is scheduled for Wednesday, when the positions of both sides will be clarified.
