Employee Takes Sexual Misconduct Case Against Governor to Supreme Court

The Governor of West Bengal, C.V. Ananda Bose, is facing allegations of sexual misconduct. A female employee at the Raj Bhavan has accused the governor and has taken the matter to the Supreme Court. The petition, filed on behalf of the contractual employee, urges a reconsideration of the immunity granted to the President and Governors under Article 361 of the Constitution.

The petitioner contends that the immunity under Article 361 leaves no recourse for victims like herself. Consequently, until the governor remains in office, she has no choice but to wait for the trial concerning the atrocities she endured.

Request for Directives on Immunity

The petition seeks directives regarding the immunity provided under Article 361, which can be issued by the Governor's Office. It also requests the police to investigate the incident, record the governor's statement, and provide security for the petitioner and her family. Additionally, it appeals for compensation for the damage to her dignity.

'Sexual Misconduct under the Pretense of Employment'

According to the complaint filed by the victim, the governor called her to his residence, the Raj Bhavan, on April 24 and May 2, under the pretext of employment and sexually harassed her.

The petition before the Supreme Court raises the issue that under Article 361 (2) of the Constitution, no criminal proceedings can be initiated or continued against the President or a state governor during their term in any court.

However, civil suits against a governor can commence two months after a written notice is served. Questioning this provision, a petition has been filed in the Supreme Court.
