'Demolishing the Home of the Accused or Guilty is Also Wrong...', Supreme Court Draws the Line on Bulldozer Actions

The Supreme Court pronounced its decision on Wednesday regarding bulldozer actions, designating it a breach of law. The court stated that demolishing houses, even if one is accused or found guilty, is unacceptable.

The court mentioned that it had taken into account the recommendations from experts. After listening to all parties involved, an order was issued. It is imperative for the rule of law to prevail. Bulldozer actions should not be prejudiced. Those wrongly affected by such actions should be compensated.

Why Should One Accused Person's Entire Family Be Punished?

The court stated that random bulldozer actions will not be tolerated. Officials cannot act arbitrarily. If one person is accused, why should the entire family be punished by demolishing their home? A family's home cannot be forcibly taken from them. Bulldozer actions, in reality, signify a disregard for the law.

Previously, the court stated that a home is synonymous with a dream, the ultimate refuge for someone. Prejudice against the accused is unwarranted. Government powers must not be abused. The punishment for crime is not demolition. You cannot demolish the home of anyone accused.

Notices Will Be Issued Under Regulations

Referring to the guidelines on bulldozer actions, the court required a minimum of 15 days' notice. A nodal officer must issue a notice 15 days in advance. The notice must be formally dispatched and posted at the construction site. Additionally, it should be uploaded to a digital portal. The court has mandated the establishment of such a portal within three months to detail these notices.

The court expressed that adherence to legal procedures is essential. Abuse of power will not be tolerated. Officials are not judges, and administrative authorities cannot serve as judges. Taking away a roof infringes on rights. The court explicitly stated that every district magistrate will appoint a nodal officer responsible for any structural demolition within their jurisdiction, ensuring timely notice provision and response reception. Thus, any bulldozer procedure will involve this nodal officer.
