The shocking case of a doctor’s rape and murder at Kolkata's RG Kar Medical College and Hospital finally finds its culmination as the main accused, Sanjay Roy, stands convicted by the Sealdah Court. A staggering 162 days have passed since August 9, 2024, when the horrific crime unfolded, shaking the core of the community. As the judge delivered the verdict, tears welled up in the victim's father’s eyes, expressing gratitude and faith in the justice system. The sentencing is set to be announced on Monday.

Additional District and Sessions Judge Anirban Das mentioned that Sanjay Roy’s punishment will be declared on Monday. He has been found guilty under sections 64, 66, and 103 (1) of the Indian Penal Code, which could result in the ultimate punishment of death or life imprisonment. Despite Roy’s repeated claims of innocence, the judge insisted he’ll have a chance to speak come Monday.

This section subjects an offender convicted of rape to a minimum of 10 years of rigorous imprisonment, extendable up to life imprisonment, along with a fine.

According to this section, if a person inflicts injuries leading to a woman’s death or a persistent vegetative state, the punishment is a minimum of 20 years of imprisonment.

This section deals with murder, carrying a penalty of either life imprisonment or death, with a possibility of a fine alongside.

The severity of the crime, with its brutal culmination in murder following rape, categorizes it as one of the rarest of rare cases. Given the nationwide protests, the likelihood of a death sentence has grown. Reflecting public sentiment, the CBI has also advocated for capital punishment.

On Saturday, the victim’s mother expressed her continued anticipation for the apprehension and sentencing of other accomplices. She stated, “Sanjay Roy has been conclusively proved guilty through biological evidence. However, we await the capture of others involved, rendering the justice incomplete for now.''

Alongside her husband, the victim's mother vowed to fight for justice until the end of their days. “The case remains open until justice is served to all who had a hand in our daughter’s murder. We await that day, longing for respite.” Judge Anirban Das affirmed that Sanjay Roy's sentencing will be declared by the court on Monday.

The CBI, in its comprehensive chargesheet, pins Sanjay Roy as the primary and sole perpetrator, excluding the possibility of gangrape. Forensic evidence, including semen samples, matched that of Roy. Voluminous material and circumstantial pieces of evidence pointed to his singular involvement in the crime.

The chargesheet delineates a decisive array of evidence: A strand of hair from the crime scene was matched to Roy post forensic examination. It included testimony from over 100 witnesses, 12 polygraph tests, CCTV footage, forensic assessments, and call records establishing Roy's culpability in the rape of the trainee junior doctor.

According to the CBI’s findings, three critical elements were pivotal in solving this case. The first being CCTV footage capturing Roy entering the seminar hall at 4 AM on August 9 and exiting 30 minutes later, with no other presence noted in that timeframe. The second was the mobile earphone discovered in the seminar hall, later confirmed to be Roy’s. The third was the unmistaken forensic DNA match from blood under the victim’s nails to Roy.

Sperm DNA, along with samples from intimate areas, confirmed the incriminating linkage to Sanjay Roy. On the fateful night, under the influence of significant alcohol, Sanjay stumbled upon the third floor of the hospital, unaware of the trainee doctor asleep inside the seminar hall. His violent assault left the victim with multiple external and internal injuries. Despite her fierce attempts to fight, Sanjay overpowered and subdued her, leaving behind evidence beneath her fingernails. Though his feeble explanations failed in court, Sanjay stands convicted today. The final sentencing awaits on Monday.
