Chief Minister Arvind Kejriwal has turned to the Delhi High Court in the wake of an Enforcement Directorate (ED) summon, and now, respite seems within grasp. In a staunch response during Thursday's hearing, the Court instructed the ED to produce evidence against Kejriwal if such evidence exists.
Prior to the hearing, Kejriwal's legal camp, led by advocate Abhishek Manu Singhvi, had demanded that the ED provide a non-arrest guarantee. Singhvi assured that Kejriwal would present himself for interrogation to the ED under the condition that the court affirm no punitive action will be taken against him.
Referencing Historical Court Decisions
Advocate Singhvi recalled numerous occasions Kejriwal has appeared in court. He raised the question whether Kejriwal could not implore a senior judges’ panel to seek immunity from punitive measures. He stated that should such an assurance be given, there would be no hesitation to appear.
Throughout the hearing, Kejriwal’s representatives insisted that the ED should defer from any severe actions until a formal response to his petition has been lodged. In response, ASG Raju questioned the applicability of these instances as exemplary precedents.
Delhi Court Grants Bail to Kejriwal
Recently, the ED issued the ninth summons to Kejriwal, requesting his presence for questioning today. He approached the Delhi High Court for a hearing on Wednesday and sought a promise of no punitive action. In an earlier legal proceeding of the Delhi Excise Policy case, the High Court scheduled the next hearing for April 22nd. Kejriwal was granted bail from a local Delhi court on Saturday in the matter of previous summonses’ non-compliance.
The Demand for Action to be Withheld
Kejriwal, who has been summoned by the ED several times, called upon the High Court to ensure a standstill on punitive measures. Pending the next hearing on April 22nd, it's a waiting game. Earlier, Kejriwal secured bail pertaining to his nonappearance following the issued summons.
BJP Accuses CM of Evading ED Summons
BJP spokesperson Harish Khurana accused Kejriwal of avoiding ED summonses once more. 'Only you comprehend the reasons behind your evasion from the AAP government,' he stated. 'You are negating the supremacy of law. Remember, the law stands paramount. Show respect to the rule of law. Your actions speak volumes, implying there is more than meets the eye.'
