Kumar's lawyer argued that Maliwal deliberately chose the CM house's drawing room for the incident, knowing there were no CCTVs. This, he claimed, was a setup to levy accusations at convenience.
The defense suggested the assault charges were intentionally framed to tarnish my client's reputation because Maliwal believes Kumar impeded her meeting with Kejriwal. There was no medical examination by the SHO on the day of the incident, the lawyer added.
Kumar's lawyer contended that the imposed charges imply an intention to disrobe, akin to ancient acts of dishonor — but questioned the actual intention in this case. He further argued about inconsistencies in Maliwal's statements, suggesting the situation was accidental rather than premeditated.

Delhi Police described Maliwal as a valorous figure and cast doubt on the defense's claim that the incident was a planned act to undermine Kumar's reputation. They underscored the absurdity of requiring Kumar's approval for Maliwal to meet Kejriwal, ironic since he was not a permanent government employee and had already been dismissed.
Maliwal's Statement in Court
In her emotional address, Maliwal stated she was severely beaten and accused the opposing faction of using its extensive machinery and trolls to intimidate her. She expressed fear for her and her family's safety if Kumar were released.
Allegations Against Bibhav Kumar
Maliwal has accused Kumar of assault at the CM's residence. Party leader Sanjay Singh later stated that CM Kejriwal took the matter seriously and would ensure strict action.
Before this, Delhi Police had informed that Maliwal reported the assault at the Civil Lines police station, and an FIR was registered. As the investigation continues, Kumar remains in custody.
Bibhav Kumar's Current Status
Kumar, detained for the alleged assault on Maliwal, is under police custody. After being questioned at the Civil Lines police station, he was arrested and his interim bail plea was subsequently rejected by Tis Hazari Court.
