Post-judicial custody, Vibhav Kumar seeks bail, court awaits Delhi Police response

Following alleged assault charges with Rajya Sabha MP Swati Maliwal, Vibhav Kumar, Personal Secretary to Delhi CM Arvind Kejriwal, has filed for bail in Tis Hazari Court. Metropolitan Magistrate Gaurav Goyal ordered Vibhav Kumar's judicial custody for four days at Tihar Jail on Friday, subsequent to which this bail application was filed.

The court has issued a notice to Delhi Police based on Vibhav Kumar's bail request. The Tis Hazari Court has listed the matter for hearing on Monday, by which time Delhi Police is expected to submit their response. The court will then commence the hearing on Monday, thereafter the defense will present their counter-arguments on behalf of Kumar.

Vibhav Kumar sent to judicial custody

Prior to the expiry of Vibhav Kumar’s police custody, he was presented before Tis Hazari Court by Delhi Police. The court has sentenced Vibhav Kumar to judicial custody in Tihar Jail until the 28th of May, meaning he will be incarcerated till that date.

Vibhav's lawyer once again questioned the necessity of the arrest in this case, citing the court's guidelines from the Arnesh Kumar matter for reference.

Vibhav's lawyer questions - Why wasn't a 14-day remand requested?

Delhi Police stated they had allowed family members and a lawyer to meet Vibhav per court instructions. Vibhav's lawyer argued that either judicial or police custody impinges on the accused's freedoms and that any demands should be reasonable.

Opposing any form of remand, Vibhav's lawyers questioned why a 14-day remand was not sought. The police's counsel responded that it is up to the investigating agency to decide the length of remand requested. Following Vibhav's presentation, the police appealed to the court for judicial custody, asserting that Vibhav no longer required police detention.
