Allahabad High Court Grants Default Bail to 11 AQIS-JMB Accused

On September 27, 2022, the UP ATS arrested the accused from Saharanpur, Shamli, and Uttarakhand following an NIA input. Among the arrested, Abdul Talha was a resident of Bangladesh. Mohammad Aleem, another accused, was said to be associated with the Bangladeshi terrorist organization Jamaat-ul-Mujahideen. However, they received bail due to no chargesheet being filed within 90 days.

The Allahabad High Court's Lucknow Bench has granted bail to 11 accused connected with the terror organizations Al-Qaida Indian Subcontinent (AQIS) and Jamaat-ul-Mujahideen Bangladesh (JMB). Due to the failure to file a chargesheet within 90 days, the Lucknow Bench granted default bail to these individuals, alleged to have been aiding terrorists linked to AQIS and JMB.

According to the legal provisions of the CrPC, if a chargesheet is not filed within 90 days, an accused is entitled to bail. Such a bail is called 'default bail.' The double bench of Justice A.R. Masoodi and Justice Manish Kumar Nigam granted default bail to all 11 accused.

Lower Court Rejected the Plea

An extension plea for time to file the chargesheet was not submitted within 90 days by the ATS. Consequently, the accused moved a bail application in the NIA Court in Lucknow, which was rejected on February 13, 2023.

Following this, the accused appealed to the High Court's Lucknow Bench against the lower court's decision. Eventually, the High Court granted default bail to Lukman, Abdul Talha, Mohammad Aleem, Nawazish Ansari, and others. It is noteworthy that the UP ATS, following an NIA input, arrested the accused from Saharanpur, Shamli, and Uttarakhand on September 27, 2022.

Among the arrested, Abdul Talha was a resident of Bangladesh, while Mohammad Aleem was reported to be associated with the Bangladeshi terrorist organization Jamaat-ul-Mujahideen.
